Policies

HeadBox 3D Terms

In the event that the Host requests HeadBox to provide 3D photography services for the Host to include in its Listing, the following terms shall apply:

  1. In consideration of payment to HeadBox of the 3D Charges, HeadBox grants the Host a non-exclusive, revocable, non-transferable licence ("Licence") to publish the 3D Images of the Venue (“Images”) on the Site, its website and in its own online media and marketing material for 12 months from the Subscription Start Date ("Initial Tern"). The Licence shall renew automatically for additional consecutive 12 month periods following the end of the Initial Term (each consecutive 12 month period being a “Renewal Term”) unless the Host provides HeadBox with at least 3 months’ written notice of its intention not to renew the Licence by no later than 3 months prior to the Initial Term or the end of the current Renewal Term (as applicable), Any subsequent use of the Images after the Initial Term will be subject to additional 3D Charges for each Renewal Term which will be £250 plus VAT per Image or as notified to the Host in advance of such Renewal Period commencing.
  1. Use of the Images can only be used within the Matterport visualisation platform and are subject expressly to agreement by the Host of the terms and conditions set out in the Matterport Terms and Conditions, a copy which can be found here: https://matterport.com/en-gb/terms-of-use
  1. HeadBox (or its licensors) retains ownership of all Intellectual Property Rights in the Images.
  1. The Host shall not grant sub-licences, in whole or in part, of any of the rights granted under this Licence, or sub-contract any aspects of exploitation of the rights licensed to it, without HeadBox's prior written consent

 

  1. HeadBox expressly forbids use of the Images, and any derived imagery and/or content, on any website or domain of a competitor of the Host or third-party agent. The definition of such competitors is solely at the discretion of HeadBox and includes, but is not limited to, Hirespace.com, Tagvenue.com and Venueseeker.com.
  1. HeadBox may terminate the licence with immediate effect by giving notice to the Host if:
  1. The Host uses any of the Images on any competitor website in breach of clause 4 above; or
  2. The Host breaches the Matterport Terms and Conditions; or
  3. The Host fails to pay any amount due under this Schedule on the due date for payment.

Travel

  1. As reimbursement for photographers’ travel costs, HeadBox will charge a flat fee of £25 for London city Venues or £100 for Venues inside or outside Greater London.

 

Accommodation & Incidental Costs

  1. As reimbursement for photographers’ travel accommodation, HeadBox will charge a flat fee of £150 + VAT per over-night stay.
  1. HeadBox charge a maximum of £50 + VAT per day for incidental costs incurred of the photographer, including but not limited to sustenance.

Warranty and Liability

  1. The use of the Images on the Site is provided "as is" with no warranty regarding the suitability of the Images for any purpose. HeadBox is not liable to the Host or to any person or entity for damages, costs or losses stemming from any usage of the Images, including but not limited to the publication of the Images on the Site.

 

Post-Production Editing

  1. Photography and post-production editing is included in the 3D Charges. Post -production editing includes the following:

Any additional post-production editing requested will be charged at a fixed fee of £50 + VAT per edit.

3D Capture Time & Date

  1. Should the Venue be unavailable, un-accessible or inappropriately prepared for the 3D Capture at the designated 3D Capture Time and Date, resulting in a delay of over 1 hour from the scheduled start time, a charge of £100 + VAT per hour of delay will be applied and due immediately.
  1. Should the 3D Capture be rescheduled within 48 hours of the agreed shoot date, a charge of £250 + VAT will be applicable and due immediately.
  1. Should the 3D Capture time and date include hours between 00:00 – 06:00, HeadBox will charge an additional £50 + VAT per hour for the photographers’ times.
  1. Should the 3D Capture time and date require an additional half or full day Capture time, then HeadBox reserve the right to charge an additional £150 or £250 respectively in addition to the contract cost.

Re-Shoots and Additional Extras

  1. Should the Host wish to re-shoot any part of the Venue or create an additional 3D Model, after the 3D Capture Time and Date has been completed, a base charge of £400 + VAT plus £200 + VAT per 1000 square feet will be applicable and due immediately.
  1. Should the Host wish to add any additional extras, it will be charged as follows:

3 x 360 Shots - £150

Google Maps Integration - £250

Schematic Floor Plans - £250

Bi-Annual Reporting - £250

 

  1. Following completion of the 3D model, the Host agrees to publicize the HeadBox 3D model via LinkedIn with a direct link to the HeadBox LinkedIn page. This shall take place no later than thirty (30) days following receipt of the completed and edited 3D model. This post must also include reference to, alongside a direct clickable link for, the LinkedIn profile of the relevant HeadBox 3D salesperson involved.
